TRUSTS
We offer advice and assistance in relation to trusts in connection with estate planning in appropriate circumstances. Trusts can be used to manage and control assets where there are uncertainties in relation to the marital, health, financial or other difficulties which may affect beneficiaries in the future. Trusts can in certain circumstances be useful for inheritance tax planning and long-term care cost planning. We can advise when and when not to use a trust and we can assist in preparation of trust documentation and registration in the Trust Registration Service (TRS).
ESTATE PLANNING
We have many years’ experience advising and assisting clients in relation to their estate planning including advice on inheritance tax and long-term care cost issues. This process usually starts with a meeting to ascertain full details of assets and liabilities and how assets are ultimately to be distributed among family and other beneficiaries. Next step is the preparation of a Will so as to ensure that assets pass in accordance with the estate plan even if untimely death occurs before the estate plan has been completed. Finally, and only in appropriate circumstances, an estate plan is made setting out plans for distribution of assets to family and other beneficiaries during lifetime. This is usually done in conjunction with accountant and/or financial adviser.
INHERITANCE TAX
We can advise in relation to potential Inheritance Tax liability and what measures can be put in place thorough careful lifetime estate planning to reduce the amount of Inheritance Tax payable on death and thereby increase the value of assets which on Will pass to family and other beneficiaries.
LONG TERM CARE COSTS
We can advise in relation to potential long term care costs and how these costs are funded from your income and capital resources. We can advise in relation to capital disregards in appropriate circumstances. Long Term Care Cost insurance may be a possible option and, if so, this can be arranged in conjunction with your Financial Adviser.
